Why have these Regulations been introduced?
The Pupils' Educational Records (Scotland) Regulations 2003 are intended to give parents a specific right of access to their child's educational records. They apply wherever such records are held by a responsible body (education authority) for the provision of school education.
Parents at local authority schools had already had this right under the School Pupil Records (Scotland) Regulations 1990. A consequence of the Data Protection Act 1998 in extending data protection to manual records as well as electronic records effectively removed this right. The regulations restore this right to parents at local authority schools.
